By accessing or using Agent Rush ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, do not use the Service.

2. Description of Service

Agent Rush is an AI-powered customer support platform that enables businesses to create, configure, and deploy chat agents on their websites and e-commerce stores. The Service includes:

• AI chat agent creation and management
• Embeddable chat widget for websites
• Shopify integration for order lookup, product search, and tracking
• Lead capture and conversation management
• Knowledge base and help center tools
• API access for custom integrations

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit harmful, fraudulent, or deceptive content
• Attempt to gain unauthorized access to other users' data
• Interfere with or disrupt the Service or its infrastructure
• Use AI agents to impersonate real people or provide professional advice (medical, legal, financial) without appropriate disclaimers
• Scrape, crawl, or harvest data from the Service beyond your own account
• Circumvent rate limits or usage restrictions

5. Shopify Integration

When you connect a Shopify store to Agent Rush:

• You authorize Agent Rush to access your store data as described in our Privacy Policy
• You may revoke access at any time by disconnecting the store from your dashboard or uninstalling the app from Shopify
• We will delete your encrypted access token and Shopify-sourced data upon disconnection
• You are responsible for ensuring your use of the integration complies with Shopify's terms of service
• Agent Rush is not affiliated with or endorsed by Shopify Inc.

6. Intellectual Property

Your content: You retain all rights to the content you provide to the Service, including agent instructions, knowledge base entries, and business data. You grant Agent Rush a limited license to use this content solely to operate the Service on your behalf.

Our platform: The Agent Rush platform, including its software, design, documentation, and branding, is owned by Agent Rush and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written permission.

7. AI-Generated Content Disclaimer

Responses generated by AI agents are produced by artificial intelligence models and may not always be accurate, complete, or appropriate. Agent Rush does not guarantee the accuracy of AI-generated responses.

• AI responses do not constitute professional advice (legal, medical, financial, or otherwise)
• You are responsible for reviewing and configuring your agent's instructions to ensure appropriate behavior
• You should inform your customers that they are interacting with an AI agent
• Agent Rush is not liable for decisions made based on AI-generated responses

8. Subscription and Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions renew automatically unless canceled before the renewal date. We may change pricing with 30 days' notice. Refunds are handled on a case-by-case basis.

9. Limitation of Liability

To the maximum extent permitted by law, Agent Rush shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for downtime caused by factors beyond our control, including third-party service outages.

11. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, except where retention is required by law.

12. Indemnification

You agree to indemnify and hold harmless Agent Rush, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the revised terms. If you disagree with any changes, you should stop using the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.
